Apogee* has a clause in their developer contracts that employees get a % of profits of each game they worked on while they still work at Apogee.

Now if they feel DNF is almost ready for release, and it's the most amazing game ever and will bring in millions of dollars, and keep the owners of Apogee rich for life, it really would be in their best interest to fire everyone a while before release.
